Can a shop sell a xbox 360 game with the microsoft seal broken?

I have bought a few games from a certain supermarket now and 2 out of 5 the microsft seal has been broken, they have just put the game cd in the display box, to me I think that the game is second hand if the seal is broken.

First off, I would not buy any games from a “Supermarket”

And if you already ran into this issue before, why do you keep buying from there?

its not second hand, and they CAN do it

what they do is take the game out of the case and put it in a secure place, so that they can display the box on the shelf, then the customer (your good self in this case) takes the box to the checkout and they scurry along and get the game out for you and then put it in the box

Ya, that happens all the time. When you buy any game that is a display copy, they take the disc out of the drawer or wherever they keep it and put it in the case. It ultimately comes down to personal preference with those types of things. If it’s a title you want, or it’s hard to find, is it that big of a deal to you not to buy the game?

GS does it all the time. They said that the game is brand new, and they took out the disk because they needed the case for display. So I guess it’s legal. Personally, I think it’s second hand because it’s used as soon as the seal is broken.

They can sell it, but have to call it second hand or preowened. Even if it is unused but the seal is broken, they can only sell it for a fraction of the origional price.

Yes, I had this problem too and what is the idiot above saying don’t buy from a supermarket. Surely we all buy games from the cheapest outlet, supermarket or not. What’s the difference.

When you buy from a supermarket ask them if they got a sealed one and if they haven’t get them to mark the receipt unsealed when you buy it.

If you buy online you will be guaranteed of getting a sealed game. As supermarket don’t trade in games you don’t run the risk of a buying a traded in game being sold as new. This could be an easy error for those stores which sell both new and second hand. I recently bought PGR 4 from GS for £19.98 new allegedly. I asked if they had a sealed game and if it was new at that price. I was told it was new but they didn’t have any sealed ones. When I got it home imy 360 flashed up an error and said the disc was dirty. On closer inspection the disc was scratched and was obviously not as new as I thought. I took it back and got another which was perfect but still not sealed. I may just ring GS to see if they got any sealed ones.

I do agree that if you buy a new game it should be new and sealed and question how GS could sell me PGR 4 new for less than the second hand ones were on sale for.

Simply, People steal games, so they take the discs out and put them in after you puchased them.

Supermarkets do it all the time, the diskd are stored in a huge locked drawer, the first game i ever bought (rainbow 6 vegas) was from TESCO I noticed that the seal was broken and when I got it home low and behold it was scratched to hell. I took it back and demanded a refund and have not bought a game from a suermarket since
