Does a tenant have to pay all back rent owed before renewing lease?

I am renting out my house and the tenant is behind on rent? They want to renew a month to month after their lease is up? They said that they don’t need to pay all the money as long as they are paying some money.

If they are behind on their rent, you have a right to evict them, but they don’t have a right to renew any kind of lease with you.

uh…it’s your house, your money. I’d never let them stay unless they paid current. Otherwise, I’d start legal action for the arrerage and evict their ***** unless you can work out a pyament plan for the back amount you are happy with; and start eviction with the first missed payment.

nope, they have to pay it in full, or you could sue. Rental law specifics vary from state to state, but most have the same general parts. As far as renewing, all you have to do is say no. Once the lease is up, you can basically kick them out, rent month-to-month, or force them to sign another year long lease. I would say that if they don’t pay up by the time the lease is up, kick ‘em, and then sue.

This all depends on the landlord but I would say pay up first or move out.

Renewing the lease, even month to month, would require you to sign it. If you, as the owner, are happy with the rent not being paid, it is your problem. I would not accept a new lease and would already be preparing for an eviction notice.
