can i get my deposit back if i signed the lease but my co signer did not?
ByI was getting a apartment and needed a co signer and so my boyfriend said he would do it do he filled out an application and we paid a 800.00 deposit
i went in and signed my part of the lease but he did not! now something has came up and i cant move in. The apartment is telling me i cant have my deposit back is this true?

Yes. If you need a co-signer, the contract is not binding until and the landlord must return your depoist.

no the lease isnt binding…best thing to do is contact landlord and tenant affairs of your county.

Think about this–the landlord or agent required a co-signer. Did the co-signer agree and sign the lease? Then the lease is not binding and you get your deposit back!
Lesson learned-don’t pay anything until all parties have signed!

No, the lease was not validated if he did not sign and you needed a co -signer! they have to return your deposit !!! You can report them too, I believe they are violatng housing laws and they can also be fined…
like someone else mentioned call your county and start there..Call the real estate board in your state too, they may be able to tell you were to report them to so you can get your money back!! Good Luck!!

Yes, I’m sorry to say -it is a lot like when you put up earnest money on a home you want to purchase - you are agreeing to put up $800 for them to hold the apartment for you. They agreed to hold your $800 as good faith so no one else could rent the apartment once you were approved, which is what happened here - you signed the lease, and then decided to back out - that $800 is compensation to the landlord for the renters he lost during the time he held it for you - it is the only way to weed out the ones who are not truly interested -

Well, a similar situation happened to me and I never got my money back either. I have also heard of this happening to others too. I think it is rather unetical of apartments to steal money like this but they do it all the time. There is really nothing you can do about it unless you happen to be related to an attorney who will write a letter to them demanding you get your money back.

Yes, it is true.
All they needed is your signature on the lease to secure the property and the deposit. If you backed out, then they get to keep the deposit.
Now you know why you needed a co-signer…you have to learn to pay what you owe and follow-through with your financial agreements.
